SUBJECT:    Mercury Ban Legislation Update
This bulletin is to provide an update on current and future mercury ban legislation in the United States, to outline the actions required of Distributors in states with legislation, and to provide information on mercury recycling programs and non-mercury alternatives.

Mercury Ban Legislation
States with mercury ban legislation do not allow the sale or installation of mercury-containing products, including mercury-switch thermostats.

Recommended Actions - Distributors in Mercury Ban States
Distributors with businesses or branches in these states are encouraged to consult each states legislation for labeling, product phase-out, notification and disposal ban requirements for mercury-containing products. It is also recommended that Distributors with branch locations in multiple states transfer any remaining stock of mercury-switch thermostats to locations in other states where no mercury ban exits. Distributors can also sell remaining mercury-switch thermostat inventory to contractors in states without mercury bans.


Recommended Actions - All Distributors
Honeywell is a proud partner and co-founder of the Thermostat Recycling Corporation (TRC), a not-for-profit corporation that facilitates the collection and recycling of all brands of mercury-switch thermostats. Honeywell encourages Distributor participation in mercury recycling through the TRC, and makes participation easy by supporting Distributors entry into the program, and purchase of recycling bins and containers with annual Marketing Development Funds (MDF) or Literature & Merchandising Funds (L&M).
